I know it’s hard to believe, but Miley Cyrus is only seventeen.  That makes her a juvenile in terms of the posting of potentially pornographic pictures.  Guess Perez Hilton forgot that …

Perez Hilton is such an idiot. He got ahold of a picture of Miley Cyrus’ hoohah and posted it on his official Twitter account UNCENSORED. Apparently this fool doesn’t realize that Miley is still only seventeen-years-old…either that, or he just doesn’t care.

It’s definitely child pornography, considering the fact that he decided that the photo should be made available for mass consumption. So sickening. I hope he gets sued or arrested for this mess.

He tweeted, “If you are easily offended, do NOT click here [REDACTED FOR OBVIOUS REASONS] Oh, Miley! Warning: truly not for the easily offended.”

Okay, there is no question that, in this age of technology, a lot of us have made statements via the internet that we wish we could take back.  Personally, I’m thinking most recently about the “OH, CAPTAIN, MY CAPTAIN” Facebook rant following a night of Captain and Coke.  Yeah, that was embarrassing.  Like, ridiculously embarrassing.  I might as well have posted, “I’m 33 years old and fucking wasted like a college kid.”

This, though … this is criminal.

Jeffrey Douglas, a Los Angeles criminal defense attorney who specializes in child pornography cases, told Salon that Hilton’s liability is “extraordinary and intense” and that it was “suicidal for him to do this.” He added: “We’re not talking about a misdemeanor. You don’t have to know what the definition of the law is; all you have to do is knowingly distribute the photograph” — which Hilton, or someone with access to his Twitter account, most certainly did. It doesn’t matter much whether Hilton took the photo, owns the photo or published the photo — as long as he knowingly distributed the link.

It’s fairly public knowledge that Perez Hilton is a famewhoring moron. However, could even he be this stupid? This is a freaking felony, buddy.

Some are speculating that the image was Photoshopped — so, what then? “Under the law, that is still a crime and it is punishable just the same,” says Douglas. “For instance, if you were to take the face of an 8-year-old and put that picture on the nude body of even an identifiable, fully developed adult porn star, it is child-porn punishable identical to if you took a photo of the actual child.” What’s more, depending on how the image is presented, there is the potential for the shot to be considered child porn even if Cyrus is actually wearing form-fitting underwear; in fact, Douglas says there has been debate in the past over similar images Hilton has published of Cyrus. All it will take is an enterprising attorney interested in making an example out of him; he could be prosecuted on the state or federal level — or both — with a conviction potentially resulting in a 15-year sentence and lifetime registration as a sex offender. Douglas says that “if he’s not prosecuted, there is one reason why: his name is Perez Hilton.”

Okay, I used to hate me some Miley Cyrus.  I think it was the gums.  Anyway, my six-year-old considers it a real treat to take in “Hannah Montana,” so I’ve seen the show enough where Cyrus’ charms have sort of grown on me.  That and the fact that she was actually halfway decent in recent film roles (trust me, nobody was more surprised than I was).  Anyway, the point is, she is still technically a child.

Hilton has posted upskirts of celebs like Britney Spears and Lindsay Lohan, but this is somehow different.  Earsucker has a censored picture posted, and I truly get the impression that the poor girl was just trying to get out of her car and life happened.  It’s not like she was lying prone with her legs spread open.  She doesn’t look drunk or disturbed or under the influence of anything other than a bad camera angle.

Obviously celebrities make a conscious decision to put themselves into the limelight.  However, the line is blurred a bit when the celebrities in question are under the age of eighteen, and it’s just disgusting that Perez Hilton took total advantage of this.  I mean, I used to drive around topless all the time on summer days when I was sixteen or seventeen not because I wanted any sort of attention but because it was damn hot and my car didn’t have air conditioning.  It truly did not occur to me how perverted truck drivers can be.  A seventeen-year-old does not possess the best judgment skills, and I would definitely argue that Miley Cyrus’ crotch shot is far more innocuous than my unintentional peep shows based on physical comfort and not anything sexual (hey, I lived in the moment at that point in my life).

  1. …EvilBeet showed these too. Generally I stick up for these two sites being connected but you didn’t even mention the fact that evilbeet also showed these very illegal pictures. I won’t post the link as distributing child pornography isn’t my thing, but it was there and another blog even took a screen shot of the censored version to lambaste Evilbeet.

      • Oh, that’s that awful site run by that horrible former commenter. Miley is pretty clearly wearing underwear in those photos. It’s a bunch of fuss about nothing — and I’m happy to capitalize on some of the drama Perez is stirring up. No one’s getting sued or going to jail for running child pornography — not Perez and not me.

          Anyone can register anything to another person on the net. If your home address is known and I have your email address, I can register all kinds of sites to you.

          Barring that, I can make up a physical address and sign you up for a very legit sounding email address.

          What people fail to understand is that unless you are extremely tech savvy – you will leave an electronic footprint that may as well have a neon flashing arrow directed at your home.

          This is all very easy to prove or disprove.

  2. Miley should be slapped on the face (preferrably by her mother) for taking/allowing these photos to be taken. If there’s anything that big sis Brit Spears has taught us all, it’s that you can and should ALWAYS afford undies.

    Perez Hilton should be slapped for being a famewhoring moron, then he should be charged for distributing child pornography. As should anyone else involved in the distribution of these photos.

    How stupid can you be? There are some iffy laws, ones that maybe you could claim, a la Dave Chappell, “I didn’t know I couldn’t do that, officer.” Distributing child pornography is NOT one of them…

    • She most likely didn’t ‘allow’ these photos to be taken. what constitutes ‘allow’ these days – becoming famous, which will inevitably lead to photographers outside your car every time you stop in the hope of catching the second you forget to hold your skirt down?

      If you’re going to say she should never be without underwear, that’s valid. But making that poor choice does not mean someone deserves to have cameras pointed at her crotch every time she steps out.

      • Well, she does take some pretty racey selfies, so having not seen the photo(s) in question, I didn’t know if that was the case.

        But yes, by “allow” what I really meant was “wearing clothing that gives everyone within a mile radius free tickets to your downtown bonaza.”

          And if she lacks underwear, it’s stupid, but still shouldn’t deserve photography any more than it should invite anyone else.

          As for the upskirts, surely we’ve all worn a skirt that might have accidentally flashed for a brief moment when getting out of a car inelegantly? I wear skirts quite rarely, but if I had ten cameras pointed at my crotch every time I got out of a car, I’m sure I’d have a photo kicking around by now.
          Of course, I do wear underpants, so it’d be a lot less thrilling.

  3. I’m agreeing with Mallory here and asking: why don’t girls wear underwear in public? I don’t understand. Have the Britney and Lohan shots taught us nothing? Underwear is our friend – it keeps everything nice and snuggly. Especially if you are a frequently paparazzi’d person, I’m begging you, when you think “shall I wear pants today?” answer: “yes! Yes I will!”.
    Unless of course Miley was wearing underwear that had… moved? I don’t know – I’m not gonna look.
    I’m not condemning her here, nor am I saying it was her fault the pictures were posted everywhere. Just saying I don’t understand going commando when wearing a skirt or dress that could fly up ala Ms Monroe when we have had SO MANY cautionary tales.

    The moral of the story: Wear pants. Wear pants that fit. Perez Hilton is a pig.

  5. I do not like Miley Cyrus. However, I despise Perez Hilton even more. And no one ever deserves to have a picture like that dispersed across the Internet for doing nothing more than getting out of a car. Throw in the fact that she is 17 and that’s it. I hope Perez gets some SERIOUS shit for this. I’ve hated his distasteful site since I first saw it and I think he needs to learn to shut the fuck up.

    Still don’t think it’s right this and Evil Beet Gossip are trying to “capitalize on some of the drama Perez’s stirring up” when Evil Beet Gossip stoops to many of the same lows Perez does. They just have better grammar, less photos of themselves with the actual celebs and less readers.

  7. Well, I think Perez Hilton is a waste of flesh, and yes it was illegal to post (or possess) that picture.

    That being said, I think people are making WAY too big a deal about it. 1) She’s 17, which is old enough to have sex (with adults even) in 39 states (with 5 more having caveats for various differences in age). 2) This is a woman who makes her living by performing in scant outfits and gyrating on poles…I doubt that she’s being taken advantage of. 3) This is not the type of situation that child pornography laws exist for. It’s not to protect a teen who can’t be bothered to wear underwear and flashes her cooch to the world. It’s to protect children who are being exploited and abused.

    Should he be prosecuted, probably (I don’t know if the DA has better things to do or not). However, I really think people are making much ado about nothing.
