15-Year-Old’s Accused Rapists Will Not Be Charged in Florida

According to a local CBS report, James Hunte and Ryan Johnson, two men who admit to “receiving a sex act” from an underage girl in an alleged six-man assault, will not be charged for their crime because the “victim in the case has been uncooperative.”

The teen told police she went to the apartment with a man she knew on April 19. Later, she claimed, five other men entered the bedroom and “forced her to have either oral sex and/or sexual intercourse with them individually.”
All the while, the teen said the men snapped photos of the activities. Police recovered a digital camera at the crime scene and discovered photos of the girl engaged in sex acts.
Um, yeah, the age of consent in Florida is 18, so it seems to me that if photo evidence exists, these perpetrators could feasibly be charged for statutory rape regardless of whether the victim is “cooperating” or not. The state is just going to let them off?
The news of this crime is troubling enough on its own, but as if to add insult to injury, the problematic word “receiving” keeps showing up in the report:
Johnson … told police during the sex act “he noticed the victim crying and discontinued receiving oral sex.”
“Receive” suggests that someone is giving you something willingly. To strike out even the vaguest suggestion of victim-blaming, wouldn’t a better verb here be “take”? Or how about, “When he noticed the victim crying, HE STOPPED FORCING HER TO PERFORM ORAL SEX”? Hm?

I agree. They should be charged with at least statutory rape (if not just rape, plain and simple).
The other thing is, wouldn’t the pictures they took be child pornography?

I don’t know if any of you have ever been raped by a stranger, I hope not, but if you do experience that you will horrified by the disgusting way the police treat you. Police are the most misogynistic assholes on planet earth, they basically assume you’re a liar and ask you the most offensive questions making it like you did something wrong. Sadly, the medical staff at the hospital are even worse.
That is so heartbreaking to know. I’ve fought my way out of three rapes so far in my 37 years. I think it worked because they were so surprised that I turned into a demon cat from hell with a good right hook. Also there was only one guy to get away from and no weapons involved. Had any of those attacks been successful–to know what would have happened with police and the ER…just pisses me off more.
OMG, lucky you. If the person has a weapon it’s kinda scary to even think about fighting ya know? What I find really gross is that in court a rapist’s past can’t be used against him but YOURS can. WTF. Feminists need to work on this and leave the coffee shop silliness alone.
Terrible treatment by the police seems to be the same across the board (I am also horrified by the way I was treated by the cops)….. but the hospital I went to had a dedicated sexual assault team, whose sole role is to see women (and men, I’d imagine) who’ve been raped. They were helpful (as much as they could be) at the time, and gave me great follow up care, so I think it might depend on where you live (I’m in Canada).

Doesn’t everyone LOVE how in rape trials the rapists history cannot be used against him/her but the victims can be used against her/him!
I moved from NY to Fl 5 yrs ago and I’m telling you that’s how it is here.I’ve never seen such backward thinking.If you notice its a running theme here.I’m just biding my time until the economy jump starts and I’m out of here.And don’t buck the old boy system here.It’ll just get you in more hot water.
